Federally Legal Hemp Coverage

CBD & Hemp Product Insurance for Brands the Standard Market Won't Touch

Federally compliant CBD products are legal. Most insurance carriers still won't write them. We've built carrier relationships specifically for hemp brands and bring full coverage to a category most brokers refuse.

Section 01 · The Reality

CBD Brands Operate Under Federal Legality and Carrier Resistance

The 2018 Farm Bill made hemp-derived CBD federally legal. The insurance market hasn't caught up. Most general ecom carriers still exclude CBD entirely. Most "any product" policies have language buried that voids coverage if the product is hemp-derived.

That means most CBD brands are running uninsured, underinsured, or insured by a policy that won't actually respond.

We've built carrier appointments specifically for the hemp niche. Underwriters who understand the difference between full-spectrum, broad-spectrum, and isolate. Underwriters who read your COAs. Underwriters who price your policy on what your product actually is, not on stigma about what hemp might be.

Section 02 · The Coverage Gap

What Standard Policies Miss in the CBD Category

Standard ecom policies typically exclude

  • Any product derived from cannabis sativa, including federally legal hemp
  • Products with measurable cannabinoid content (CBD, CBG, CBN, etc.)
  • Topical and ingestible products in the hemp family
  • Brands selling through dispensary or smoke shop channels
  • Products subject to state-specific cannabis or hemp regulation

What a CBD-built policy covers

  • Federally compliant hemp-derived CBD products with COA documentation
  • Full-spectrum, broad-spectrum, and isolate formulations
  • Topicals, tinctures, gummies, edibles, beverages, capsules, vapes (where allowed)
  • DTC, retail, dispensary-adjacent, and smoke shop channels
  • Multi-state operations with appropriate state-specific coverage
Section 03 · Who We Protect

Built for the Hemp Brands the Standard Market Walked Away From

CBD topicals & skincare

Lotions, balms, salves with cannabinoid content. Lower carrier resistance, easier underwriting, often the entry point for the category.

Tinctures & ingestibles

The bulk of the CBD market. Coverage requires careful underwriting on COA documentation and label claims.

CBD gummies & edibles

Sit at the intersection of supplement and CBD. Two regulatory frameworks, one policy.

Hemp beverages

The fastest-growing slice. THC-infused (where legal) and CBD-only beverages. Carrier appetite is limited but real.

Section 04 · Common Questions

CBD Insurance, Plain English

Is CBD insurance more expensive than regular ecom insurance?
Often yes, sometimes by 2x to 5x compared to a non-hemp product. The exact premium depends on your product type, your channels, your COA documentation, and your claim history. Topicals are generally cheapest. Ingestibles run higher. We shop the market specifically for hemp-friendly carriers to find the best fit.
Will my insurance cover me if a customer gets a positive THC drug test?
This is the most common CBD claim. The right policy responds to it. Standard policies often have language excluding "intoxicant" or "drug" claims that can be invoked here. We use carriers that have written CBD long enough to have policy forms that respond to this exact scenario.
What documentation do I need before applying?
A current Certificate of Analysis (COA) per SKU showing cannabinoid content under federal limits (≤0.3% Delta-9 THC by dry weight). Your label, your manufacturer information, your channels (DTC, retail, dispensary, etc.). Some carriers also want batch testing history. We'll send you a checklist when you start your quote.
Can I sell CBD on Amazon?
No. Amazon prohibits CBD listings outright as of 2026. If you sell CBD, you're not on Amazon. Your sales channels are Shopify, your own DTC site, retail, dispensary, smoke shop, and limited marketplaces (Faire, etc.). We size your additional insured endorsements to your actual channel mix.
What about Delta-8, Delta-10, HHC, THCa?
Hemp-derived intoxicating cannabinoids are a separate underwriting conversation. Federally legal under the 2018 Farm Bill but state-by-state legality varies and many carriers exclude them. We can place coverage for some of these categories with the right carrier. Send us your product list and we'll tell you what's writable.
Does this cover my dispensary-adjacent products?
If you sell into licensed cannabis retail, the dispensary's own policy covers them on premises. Your policy needs to cover product liability for what you make. We've structured policies for hemp brands selling into dispensary channels for years.
