Professional Liability for Formulators, Label Writers, and Supplement Consultants

If you formulate supplements, write labels, advise on compliance, or consult on cGMP processes, you are personally on the hook when one of those formulations or claims is questioned later. This is the policy that defends you.

Why It Matters

The Liability Most Founders, Formulators, and Consultants Don't See Coming.

Product liability covers what your finished product does to a customer. Professional liability covers what your ADVICE, formulation, or labeling decision does to your client's business. The two policies work together. Without both, you have a gap.

Defends you against

  • Failed formulation claims (didn't deliver promised effect, didn't meet spec)
  • Mislabeling and labeling errors traced back to your work
  • cGMP and compliance advice that didn't hold
  • Ingredient sourcing recommendations that turned out to be non-compliant
  • Claims advice that triggered FDA warning letters or marketplace suppression
  • Errors in regulatory filings, monograph alignment, or DSHEA positioning

Pays for

  • Legal defense from the day a claim is filed
  • Settlement amounts within your policy limits
  • Court-ordered damages and judgments
  • Discovery, expert witness, and consulting costs
  • Coverage even when claims are unfounded
Who Needs It

If you give advice that ends up on a label or in a formulation, this is you.

01

Formulators

You design supplements, beauty products, or OTC formulations. When the formulation is questioned later, your professional liability defends you separately from your client's product liability.

02

Label writers

You write Supplement Facts panels, drug facts panels, ingredient lists, structure-function claims. Mislabeling claims trace back to whoever wrote the label.

03

Supplement consultants

You advise brands on compliance, ingredient selection, manufacturer choice, regulatory filings. Bad advice creates client losses that come back to you.

04

cGMP consultants

You audit manufacturers, write SOPs, advise on FDA inspection prep. When the inspection goes badly and the client claims you missed something, you need defense.

05

Founder-formulators

You're the brand owner AND the formulator. Both sides of liability are personally on you. Stack product liability and professional liability so both are covered.

06

Compliance attorneys & agents

You file with FDA, register facilities, prepare COIs. Errors and omissions in these filings have direct client losses tied to them.

Real Claim Scenarios

What a professional liability claim actually looks like.

Composite scenarios drawn from the niche. Names and details adjusted for privacy.

Formulator

Formulation effectiveness lawsuit

A nootropic formulator developed a "memory blend" that customers later sued the brand over for not delivering claimed cognitive effects. The brand pulled the formulator into the lawsuit. Coverage funded the formulator's separate defense.

Label Writer

Mislabeling traced to label writer

A supplement Brand X received an FDA warning letter for unsubstantiated structure-function claims. Brand X identified the consultant who wrote the label, sued for damages from the regulatory action. Professional liability defended the writer.

cGMP Consultant

Failed FDA inspection blame

A consultant audited a contract manufacturer and certified them cGMP-aligned. FDA inspected and found violations. Brand sued the consultant for the cost of finding a new manufacturer and the lost product. Coverage funded the response.

Common Questions

Professional Liability, Plain English

Doesn't my product liability already cover this?
No. Product liability covers harm to the customer caused by the finished product. Professional liability covers losses to your CLIENTS caused by your advice, formulation work, or label writing. Two different triggers. Most consultants don't realize the difference until a client sues them and product liability won't respond.
I'm a brand owner who also formulates. Do I need both?
Yes. As the brand, you have product liability exposure to consumers. As the formulator, you have professional liability exposure to anyone who paid you for the formulation work. If you sell formulations to other brands, this is critical. If you only formulate for your own brand, professional liability is still recommended because of how strict liability law treats formulators in the chain.
What about errors and omissions for compliance work?
Same coverage, different name. Errors and Omissions (E&O) is the term used in financial and legal services. Professional Liability is the umbrella term. Same coverage trigger. We use the right policy form for your specific work.
Does professional liability cover FDA warning letter response?
Indirectly. The policy doesn't pay FDA fines, but it pays your defense costs when CLIENTS sue you because of an FDA action that traces back to your advice or formulation. The chain matters: bad advice → FDA action → client losses → client sues you → policy pays.
What does professional liability typically cost?
Depends on your scope of work, revenue, and claim history. Solo formulators often start in the low thousands annually. Larger consulting practices and multi-state operators can run higher. We size the policy to your real exposure.
Will the same policy cover my cGMP consulting and my formulation work?
Usually yes, with the right policy form. We make sure the scope of work definition on the policy includes everything you actually do, not just one slice of it.

Get the policy that defends your work, not just your product.

If you formulate, label, or consult for the supplement, beauty, OTC, or ingestible space, this coverage is non negotiable.
